Grimmarch terms of service

These terms are the agreement between you and AppsByLuke for playing Grimmarch and using its online service. Please read them. We wrote them in plain language. They do not take away any rights you have as a consumer under the law.
A Polish version of these terms is available at grimmarch.com/legal/pl/terms. For consumers in Poland, the Polish version prevails.
Our privacy policy explains how we handle your personal data.
1. Who we are
Grimmarch is made and published by AppsByLuke.

Our single point of contact for authorities under the Digital Services Act, and for players and anyone else, is support@grimmarch.com, in English or Polish.
In these terms, "we" and "us" mean AppsByLuke, and "you" means the person playing Grimmarch.
2. What you are buying
Grimmarch is a paid game sold through Steam, for Windows and Linux.
- You buy the game once, on Steam. Steam is the seller, takes your payment, and delivers the game under the Steam Subscriber Agreement, which also applies to your purchase.
- Nothing is for sale inside Grimmarch. There are no in-game purchases, no cosmetics for sale, no season pass, and no way to spend money in the game. Everything you earn in the game is earned by playing.
- Grimmarch is online-required. You need an internet connection to play, because your account, progress and battles are kept on our servers. The game cannot be played offline.
- Technical requirements. A computer running Windows or Linux that meets the minimum requirements on the Steam store page, a Steam account, and a stable internet connection.
Accepting these terms. These terms are shown on the Steam store page before you buy Grimmarch, and you accept them when you buy it. The first time you start the game, it shows you these terms and our privacy policy and asks you to accept them before you play. If you do not accept them, do not play, and you can ask Steam for a refund.
3. Your licence to play
When you buy Grimmarch, we give you a personal, non-exclusive, non-transferable licence to install and play the game for your own non-commercial use, for as long as you keep your right to it on Steam and these terms are not ended under section 10.
You may not:
- copy, sell, rent, or distribute the game or its content, except as Steam allows;
- decompile, reverse engineer or modify the game or our servers, except where the law allows you to do so despite this term;
- use cheats, bots, automation, or modified clients, or access our online service in any way other than through the game;
- exploit bugs to gain an advantage, or keep using one once you know about it; please report it to us instead;
- interfere with, overload or attack our servers, or try to reach data or accounts that are not yours.
4. Your account
- You must be at least 13 years old to play Grimmarch. If you are under 18, you need your parent's or guardian's permission to play and to accept these terms.
- A guest account is created for you the first time you start the game, unless you sign in instead. A guest account is tied to that computer.
- Add a sign-in method to protect it. You can add an email address and password, a Steam account or a Google account. Your progress is then kept on your account, and you can sign in to it from another computer if you lose this one or delete the game's files. Without a sign-in method, your account can be reached only from the computer that created it, and we cannot recover it if that computer or the game's files are lost.
- Unused guest accounts are deleted. A guest account with no sign-in method that has not been used for 12 months is deleted automatically. The game reminds guests to add a sign-in method.
- Keep your sign-in details to yourself. You are responsible for what happens on your account unless someone reached it through a fault of ours or in a way you could not reasonably have prevented.
- One account is for one person. You may not sell, trade, give away or share your account, or buy or use someone else's.
- Characters. An account can hold up to three characters. Deleting a character permanently removes it with its deck, cards, Whetstones, currency, level and talents, and the game will ask you to confirm first. We cannot restore a deleted character.
- Nothing in the game has money value. Cards, Whetstones, currency, items, titles and other things you earn are part of the game. They are not your property, cannot be exchanged for money, and cannot be transferred to another account.
- Deleting your account. You can delete your account at any time from Settings in the game. It is erased 14 days later unless you sign in again before then, as described in our privacy policy. Once it is erased, your progress is gone permanently.
5. Names and how you treat other players
Grimmarch has friends, Expeditions, Free Companies, player names and Free Company names. It has no free-text chat.
When you choose a player name or a Free Company name, it must not:
- be hateful, harassing, sexually explicit, threatening or discriminatory;
- impersonate another person, a Grimmarch developer or AppsByLuke;
- contain personal information about anyone, including you, such as a real name, address or phone number;
- advertise anything or point people to another website or service;
- break the law or infringe someone else's rights.
You must also not use invitations, friend requests, reports or any other feature to harass other players, and you must not make reports you know to be false.
6. Reports and moderation
How we moderate. Names are checked by an automatic word filter when they are chosen, and the filter may refuse a name. Passing the filter does not mean a name is acceptable under these terms. Reports are reviewed by a person. Automated tools do not restrict, suspend or close accounts.
Reporting in the game. You can report a player name or Free Company name you think breaks section 5, and you can block any player.
Reporting illegal names by email. Anyone, including someone who does not play Grimmarch, can tell us about a player name or Free Company name they believe is illegal by emailing support@grimmarch.com with the name, where it appears, and why they believe it is illegal. We confirm receipt, decide promptly and objectively, and tell the sender what we decided and how to challenge it.
If we decide a name or behaviour breaks these terms or the law, we may, depending on how serious it is and whether it has happened before:
- reset the name to a generated one;
- restrict features on the account, such as choosing names or sending invitations;
- suspend the account for a period;
- close the account, under section 10.
When we restrict a name or an account, we tell you what we did, the facts and the section of these terms or the law we relied on, whether it followed a report, whether automated means were involved, and that you can appeal to us under this section, go to court, or contact your consumer authority, unless the law prevents us from telling you.
If you disagree with a decision, email support@grimmarch.com within 6 months of it. A person reviews it and tells you the outcome within 14 days.
We keep a record of reports and the actions we take, as described in our privacy policy.
7. The online service
- Availability. We work to keep Grimmarch running. Short interruptions for maintenance or updates, or brief outages, can happen. When we plan maintenance, we try to tell players in the game beforehand. Lasting faults that stop the game working as described are covered by your statutory rights below.
- Updates and changes. Updates may add, change, rebalance or remove content and features, to fix faults, keep the game secure, keep it fair and balanced between players, comply with the law, or improve it. Updates cost you nothing. Some updates download automatically, and you may need the latest version to keep playing. If a change significantly reduces your ability to access or use Grimmarch, we will tell you in the game, on grimmarch.com, and by email if your account has an email address, at least 30 days before it takes effect, and you may end this agreement free of charge within 30 days of the change, in which case you are entitled to a proportionate refund of the price.
- Your statutory rights. As a consumer in the EU, you have the right to a game and online service that match what was described and work as the law requires, including the updates needed to keep them working. Nothing in these terms limits that right.
- Security risks. Using any online service carries risks such as malware and phishing. Download Grimmarch only through Steam. We will never ask for your password by email.
- Ending the service. If we ever decide to shut down Grimmarch's online service permanently, we will announce it at least 90 days beforehand, in the game, on grimmarch.com and on the Steam store page. We will ask Valve to refund, through Steam, purchases of Grimmarch made in the 6 months before the announcement. If you bought Grimmarch in that period and Valve does not refund you, you can ask us for the price back at support@grimmarch.com, and we will refund it. This refund is additional to, and does not limit, any statutory remedy you have, whenever you bought the game.
8. Refunds and complaints
Grimmarch is bought on Steam, so refunds are handled by Steam under Steam's refund policy. Please request a refund through Steam.
Since nothing is sold inside the game, there are no in-game purchases to refund.
Complaints. If Grimmarch or its online service does not work as described, email support@grimmarch.com with your player name or friend code and a description of the problem. We will answer within 14 days. You may ask us to bring the game into conformity, and if we do not or cannot, you may ask for a price reduction or end the agreement, as the law provides. This does not depend on Steam's refund policy.
9. Our content and your feedback
Grimmarch, including its code, art, audio, text, characters and world, is protected by law, and these terms do not give you any rights in it beyond the licence in section 3.
If you send us ideas or feedback, we may use them to improve Grimmarch without owing you anything for it.
10. Ending this agreement
You can stop playing at any time, and you can delete your account as described in our privacy policy.
We may suspend or close your account only if you seriously or repeatedly break these terms, for example by cheating, attacking our service or harassing other players. Except where it would harm other players, our service or an investigation, we will warn you first and give you a chance to stop. We will tell you why we acted and how to appeal under section 6.
If we close your account because you seriously or repeatedly broke these terms, you lose access to your account and your progress, and we do not refund the price, to the extent the law allows. If your appeal succeeds, we restore your account. You can still ask us for a copy of your personal data. How long we keep a closed account's data is in our privacy policy. None of this affects your statutory rights as a consumer.
Sections 4 (that items have no money value), 9, 11 and 12 continue after this agreement ends.
11. Liability
Nothing in these terms excludes or limits our liability to you as a consumer where the law does not allow it to be limited, including for:
- death or personal injury caused by our negligence;
- fraud;
- harm we cause intentionally or through gross negligence;
- damage caused by a dangerous product;
- your statutory rights as a consumer, including your rights if the game or service is not as described or not working.
Subject to that, we are not liable for loss that was not reasonably foreseeable when you accepted these terms, for loss caused by events outside our reasonable control, or for loss of in-game items, progress or currency, which have no money value, except where it was caused by our fault.
12. Law and disputes
These terms are governed by the law of Poland. If you live in the EU, you also keep the protection of the mandatory consumer laws of the country where you live.
If you have a problem, please contact support@grimmarch.com first, and we will try to resolve it. You can bring a claim against us in any court that has jurisdiction under the law, including the courts where you live or the Polish courts for Wrocław. If we bring a claim against you as a consumer, we will do so only in the courts of the country where you live.
We do not use an out-of-court dispute resolution body. If we cannot resolve your complaint, we will tell you so by email, and whether we agree to out-of-court resolution. You can contact the consumer authority where you live for help; in Poland, that is the consumer ombudsman (rzecznik konsumentów) for your city or district. If you live in another EU country, the European Consumer Centre in your country can also help.
13. Changes to these terms
We may change these terms only for one of these reasons:
- a change in the law, or a decision of a court or authority that applies to us;
- a change to Grimmarch's features that section 7 allows;
- protecting players or our service against fraud, cheating or security threats;
- making the terms clearer without reducing your rights.
We publish every version here with its date. We will tell you about a change in the game and on grimmarch.com at least 30 days before it takes effect. Changes do not apply to anything that happened before they take effect. If a change is to your disadvantage and you do not accept it, you can end this agreement before it takes effect by deleting your account, and your statutory rights, including any right to a refund, are not affected.
